⭐ EXAM FAVOURITE
Legislation appears in all 6 of the papers analysed (6/6). Expect an essay or scenario worth 30-40 marks. Every Act is tested against the same 7-question framework.
A little bit every day beats a lot one day.- learn the framework once, apply it eight times over
All 8 of these Acts were promulgated after 1994 to redress the injustices of apartheid and ensure equality and fairness.
What you must be able to do
Apply the P-I-O-S-M-B framework to any Act, giving its purpose, impact, offences, sanctions, methods of compliance and broader aspects
Name each of the eight Acts in full, with its number, its year and the body that enforces it
Explain how the skills levy is funded and how it is split between the SETA and the National Skills Fund
State the BCEA provisions for working hours, overtime rates, leave and child labour without confusing the time periods
List the five B-BBEE pillars and distinguish the B-BBEE Act from the BEE policy
Identify the Act a business in a scenario is not complying with and quote the wording that proves it
Distinguish consumer rights under the NCA from those under the CPA
The 7-question framework (apply it to EVERY Act)
⚡ MUST MEMORISEP-I-O-S-M-B - for any Act, know: Purpose · Impact (positive + negative) · Offences · Sanctions · Methods of compliance · Broader aspects (SETAs, rights, provisions, pillars, ...). Learn the framework once; apply it eight times over.
The 8 Acts on one page
Act (verbatim)
No. & year
Core purpose

Regulates the employer-employee relationship; collective bargaining

Labour inspectors
COIDA - Compensation for Occupational Injuries & Diseases Act
No. 130 of 1993
Compensates employees for work injuries/illnesses

🔥 FREQUENTLY TESTED
The negative impact is the same across all 8 Acts: TCPA - Time-consuming, Costly, Prescriptive, Administration-intensive. And the sanctions ladder is the same everywhere too: compliance order → fines → imprisonment → licence withdrawn.
Purpose: regulates labour relations; promotes collective bargaining
Established the CCMA, Labour Court and Labour Appeal Court
Employer right: lock-out during unprotected strikes
Employee right: join a trade union; strike legally; workplace forum (100+ employees)
EEA - employment equity
Primary purpose: promotes affirmative action
Equal pay for work of equal value
Employment equity plan = 5 years; report submitted annually to the Dept. of Employment and Labour (annual since the EEA Amendment Act 47 of 2013; older sources still say every 2 years)
The workplace must reflect the country's demographics
⚠️ COMMON MISTAKE
Don't swap the time periods around: the plan covers 5 years, but the report is submitted annually. And it is the EEA (not B-BBEE) that primarily promotes affirmative action.
BCEA - the basic conditions of employment
Provision
What the Act says
Working hours
Max 45 hours/week; 9 hours/day (≤5 days) or 8 hours/day (>5 days)
Overtime
Max 3 hours/day, 10 hours/week; 1½× on weekdays & Saturdays, 2× on Sundays & public holidays
Meal breaks
60 minutes after 5 consecutive hours (can be reduced to 30 minutes)
Annual leave
21 consecutive days per year
Maternity leave
4 consecutive months
Sick leave
30 days / 6 weeks per 3-year cycle
Parental leave
10 consecutive days, unpaid (claimed from the UIF)
Family responsibility leave
3-5 days paid per year
Child labour
Younger than 15 = illegal; under 18 no hazardous work
Notice period
≤6 months' service = 1 week; ≥1 year's service = 4 weeks
⚠️ COMMON MISTAKE
Overtime rates are frequently mixed up: 1½× on weekdays and Saturdays, 2× on Sundays and public holidays. And sick leave is 30 days over 3 years, not per year. Parental leave is unpaid - don't confuse it with maternity leave (4 months).
B-BBEE - the 5 pillars
📖 KEY DEFINITIONBEE vs B-BBEE: BEE is a government policy (not enforceable, 3 pillars). B-BBEE is an Act (enforceable, 5 pillars) that spreads wealth more broadly.
The 5 pillars
Management control - black people in senior/management positions
Ownership - black shareholding & entrepreneurs
ESD - enterprise and supplier development (supports black SMMEs)
Skills development - training black employees
Socio-economic development - CSI/community projects
⭐ EXAM FAVOURITE
B-BBEE is the only Act with a specific penalty figure: a fine of up to 10% of annual turnover. Fronting (misrepresenting compliance), nepotism (favouring family) and cronyism (favouring friends) are contraventions.
⚡ MUST MEMORISENCA = the LOAN; CPA = the SHOP. NCA rights are about credit (applying without discrimination, reasons for refusal, debt review). CPA rights are about products (the right to choose, fair dealing, information, safe goods, a 5-day cooling-off period).

ONE-MINUTE SUMMARY
Eight post-1994 Acts redress the injustices of apartheid. Each is tested using P-I-O-S-M-B. The negative impact (TCPA) and sanctions ladder (order → fine → imprisonment → licence withdrawn) are the same across the board. Know the SDA's money flow (500-1-80-20), the LRA's C-L-L ladder, the EEA's affirmative action, the BCEA's key figures, and B-BBEE's 5 pillars.
IN THE EXAM
Scenario question (12 marks): identify FOUR Acts a business is not complying with, using a quote from the scenario as motivation.
Multiple choice (2 marks): which Act established which body; which leave type matches which time period.
Essay (40 marks): often combines two Acts, e.g. "describe the BCEA's provisions + discuss the impact of the LRA".
Master at least FIVE facts per heading, this is a proven exam tip.
