🔥 FREQUENTLY TESTED The negative impact is the same across all 8 Acts: TCPA - Time-consuming, Costly, Prescriptive, Administration-intensive. And the sanctions ladder is the same everywhere too: compliance order → fines → imprisonment → licence withdrawn.

The three most-tested Acts

SDA - skills & SETAs
  • Purpose: develop skills, redress imbalances, improve productivity
  • Money: payroll of more than R500 000/year → pay a 1% skills levy to SARS
  • Split: 80 percent to the SETA, 20 percent to the National Skills Fund
  • SETA's role: registers learnerships, approves workplace skills plans
LRA - labour peace
  • Purpose: regulates labour relations; promotes collective bargaining
  • Established the CCMA, Labour Court and Labour Appeal Court
  • Employer right: lock-out during unprotected strikes
  • Employee right: join a trade union; strike legally; workplace forum (100+ employees)
EEA - employment equity
  • Primary purpose: promotes affirmative action
  • Equal pay for work of equal value
  • Employment equity plan = 5 years; report submitted annually to the Dept. of Employment and Labour (annual since the EEA Amendment Act 47 of 2013; older sources still say every 2 years)
  • The workplace must reflect the country's demographics
⚠️ COMMON MISTAKE Don't swap the time periods around: the plan covers 5 years, but the report is submitted annually. And it is the EEA (not B-BBEE) that primarily promotes affirmative action.

BCEA - the basic conditions of employment

⚠️ COMMON MISTAKE Overtime rates are frequently mixed up: 1½× on weekdays and Saturdays, 2× on Sundays and public holidays. And sick leave is 30 days over 3 years, not per year. Parental leave is unpaid - don't confuse it with maternity leave (4 months).

B-BBEE - the 5 pillars

📖 KEY DEFINITION BEE vs B-BBEE: BEE is a government policy (not enforceable, 3 pillars). B-BBEE is an Act (enforceable, 5 pillars) that spreads wealth more broadly.
The 5 pillars
  • Management control - black people in senior/management positions
  • Ownership - black shareholding & entrepreneurs
  • ESD - enterprise and supplier development (supports black SMMEs)
  • Skills development - training black employees
  • Socio-economic development - CSI/community projects
⭐ EXAM FAVOURITE B-BBEE is the only Act with a specific penalty figure: a fine of up to 10% of annual turnover. Fronting (misrepresenting compliance), nepotism (favouring family) and cronyism (favouring friends) are contraventions.
⚡ MUST MEMORISE NCA = the LOAN; CPA = the SHOP. NCA rights are about credit (applying without discrimination, reasons for refusal, debt review). CPA rights are about products (the right to choose, fair dealing, information, safe goods, a 5-day cooling-off period).

ONE-MINUTE SUMMARY Eight post-1994 Acts redress the injustices of apartheid. Each is tested using P-I-O-S-M-B. The negative impact (TCPA) and sanctions ladder (order → fine → imprisonment → licence withdrawn) are the same across the board. Know the SDA's money flow (500-1-80-20), the LRA's C-L-L ladder, the EEA's affirmative action, the BCEA's key figures, and B-BBEE's 5 pillars.
IN THE EXAM
  • Scenario question (12 marks): identify FOUR Acts a business is not complying with, using a quote from the scenario as motivation.
  • Multiple choice (2 marks): which Act established which body; which leave type matches which time period.
  • Essay (40 marks): often combines two Acts, e.g. "describe the BCEA's provisions + discuss the impact of the LRA".
  • Master at least FIVE facts per heading, this is a proven exam tip.
